Billion Dollar Class Action Lawsuit Filed Again Ebay For Allegedly Shortchanging Its Sellers
A class action lawsuit has been filed against Ebay For “unlawful, unfair, fraudulent and unconscionable tactics”. The lawsuit alleges that Ebay claims that auctions will begin when an item is submitted. However, in reality, the lawsuit alleges that auctions do not fully begin when the an item is submitted. Thus, the lawsuit alleges that customers pay for more auction time then they actually get. The lawsuit alleges that Ebay violated a number of laws, including the California Auction Act by making misrepresentations in conducting its auctioneering business. The lawsuit seeks a number of remedies, including a “$1,000 per Class member civil penalty”, which comes out to over 1 billion dollars in damages if one does the math. –that’s a lot, even for Ebay.
The lawsuit (Ewert v. Ebay, 2007-cv-2198) was filed in the Northern District of California, San Jose Division. A copy of the complaint is available here, (PDF)
Well, now this all strikes as funny for one reason; The hackers are getting through just fine. I have more than one consumer awareness video posted at youtube, wherein wee see hijacked listings showing within minutes of being submitted. One example is for sure documented in a slide show, and a video both.
I do not have the time to go through all the vids right now, but here is another one which comes to mind as showing listings appear almost instantly. Of course, there was much more to that episode.
At any rate, I suspect there may be hard times ahead for ebay, as the number of various lawsuits for all manner of reasons rises, it will also embolden others to do likewise.
…And rightfully so.

I had sales of 240 dollares on ebay. I have never recieved one red cent from ebay. I had about 160 dollar coming to me from defective products and just palin fraud by so sellers. I have never recieved on red cent from ebay on those refunds. I was billed over twice as much as my sales were in ebay fees. Seems to me the only people making money on ebay is ebay.
I would like to join a class action lawsuit against and or complainst to some government agency who is responsible to make sure ebay doesnt break the law. Please contact me at rippedoffbyebay@yahoo.com

I also got ripped off by eBay. I sold something, mailed it, and buyer lied about not receiving it (he said that his post office told him that they have no record of handling this item, when I inquired with a serial number, they confirmed that they did)
but eBay refuse to look into it and gave them a full refund, so I basically mailed something out for free. Not only that, but they sent debt collections agency after me for unjustified seller fees associated with this item, and after I paid it, and fought with the representative, they agreed to refund that portion. But they’ve done it to hundreds if not thousands of other sellers, and made it off with their money which they are not entitled to.
Now, eBay tells me that they’re going to work with paypal to ask me to pay them the amount that was refunded (from my paypal account already)
basically I’m being ripped off three times.
I WANT TO JOIN A CLASS ACTION AGAINST EBAY!

Same here, I shipped out a laptop, customer claims it wasn’t as described, eBay refunded the buyer, took the money out of my PayPal account even before I received the laptop back (Rather trusting aren’t they) buyer claims they shipped it back, we never saw it, out the money and the laptop.
I want to join the law suit, please send me details.

purchased a roller cam, roller lifters and valve springs listed as “good used” and “new”. Got the parts after paying $182.00 and found the above items to be garbage. (camshaft bent .070″, lobe damage on 3 lobes,8 cracked lifters and springs worn so badly metal was missing on them.(listed as “new”). upon making a claim to ebay, ebay read our emails and PROVED this guy to be a liar,but still decided in his favor.I would like to be included in the lawsuit against these crooks.

I want in! I have had more mysterious charges taken out of my account. Customer service is poor at best and there is NO dispute process for your seller fees as Ebay owns Paypal! Ebay allows buyers to rip the sellers off and does NOTHING to help the seller. They just add insult to injury and take the money for the privelage to sell on Ebay. Count me in!

eBay / PayPal take what ever they want when ever they want it.
No appeal possible on an eBay decision.

Can the way E-Bay manipulates searches buy putting certain sellers at the top of search results. This happened to me, I was unable to pay fees because of the way searches were being manipulated and how the search function did not work the way it was. If you don’t sell how in the world are you to pay the fees they gouge you with.

“the search function did not work the way it was” supposed to. If I cannot find one of my items how are buyers supposed to? This limits my bottom line. In the past it was easier to sell things were less complicated. Can they be sued for interfering with a persons livelyhood? Sellers used to be able to make a living off E-Bay but since JD came along with his “visions” one can’t.

Put me in on this class action law suit, I have had all I can take from ebays, BS and the fees. I did at one time have any as 200 items running on ebay and now I do about 25 items a month. I am on Webstore and Boocoo– Ebid and doing good. thanks

I sold $96.00 worth of items, and eBay is charging me almost $60.00 in seller fees!! And this includes the 50 FREE listings per month, and a “sale” of 1 cent listings (unlimited amount). WHAT?? WTH?? How can eBay take 60% of my sales $$? This is so wrong in so many ways! Count me in. Ebay makes sellers poor. :(

I also was charged more than 60 percent in fees for my sales during the past 60 days. At this time I have closed both my ebay and paypal acconts and looking for an alternative as well as a class action to become part of. By the way, according to ebay it takes 180 days to close your account. thats six months ?? WHAT.

Ebay changes your preferences to allow buyers to alter your invoices and they change your calculator to charge more in shipping, you are either paying fees on the full amount even if you refund an over payment or penalize by a violation so it looks like it’s your fault. Ebay will give you false information on listings and listing violations you re list under thier instruction, they hit you again, so that you won’t qualify for the discount on you invoice. CROOKS CROOKS or very uninformed employees under direction of the crooks wanting to make quota. Come forward ebay employees and reveal the truth about upper management who use you as guinea pigs.

found out ebay does not practice what it wants,bought from a deceptive dealer who does not list the item (boat) in its true deplorable condition,with no faults and or the correct serial number,,was pointed out to ebay,ebay motors and paypay,seller should be delisted but ebay will do nothing and seller will not refund the $500.00 dep.,ebay removed the negitive feedback even after telling buyer to post it,seller relisted boat with another ad with a picture of a differant boat and sold it for $650.00 more than i had bid,ebay notified of deceptive ad and or practice,this is thief by deception and condoned by ebay,motors and paypal,seller would not try to resolve issue only made threats,issue of refund going to small claims,,,but condoning agents such as this is thief by deception and should be stopped,,,would be happy to help control ebay through a class action suit as it appears they need one,,,,,thanx
